"The misdemeanor with which defendant herein is charged arises as an alleged law violation based upon defendants negligence and which negligence is defined under the manslaughter statute (13-456 A.R.S.) as a necessary element of the offense charged. In such respect, therefore, and unlike the usual criminal charge where criminal intent is a necessary element of the crime, the elements of negligence under civil and common law principals [sic] appear to enter into a determination of this particular type of offense.
